ข้อตกลงและเงื่อนไข
In consideration of my registration to Bike Zone Events or my participation in any events, I hereby agree and acknowledge the following, which includes terms and conditions of registration, which will apply to all of my participation in all events, including any such activities of Bike Zone Events (individually an “Event”). (ข้าพเจ้าตกลงยินยอมผูกพันและปฏิบัติตามข้อตกลงและเงื่อนไขต่าง ๆ ของการลงทะเบียนตามที่ระบุไว้ในข้อตกลงดังกล่าวในการเข้าร่วมกิจกรรมของไบค์โซนอีเว้นท์ทุกประการ ซึ่งต่อไปนี้จะเรียกว่า “กิจกรรม”)
- In consideration for being allowed to participate in the Event, the Participant, on behalf of himself or herself, and his or her heirs, executors and administrators, hereby waives and releases any and all rights and claims for damages, including but not limited to, the loss of his or her belongings, or any other item of personal property, that the Participant may have against the organiser for any and all injuries suffered by Participant as a result of taking part in the Event.
(ในการพิจารณาเข้าร่วมกิจกรรม ผู้เข้าร่วมกิจกรรมตกลงที่จะละเว้นการเรียกร้องค่าเสียหาย ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะ ทรัพย์สิน สูญหาย หรือทรัพย์สินส่วนบุคคล อาการบาดเจ็บที่อาจเกิดจากความประมาท จากทั้งคณะผู้จัดกิจกรรม ผู้สนับสนุนกิจกรรม และ บุคลากรทุกฝ่ายที่เกี่ยวข้องกับกิจกรรม รวมทั้งตัวแทน เจ้าหน้าที่ ผู้อำนวยการ สมาชิก และผู้รับจ้างทำการของกิจกรรม) - Participant grants full permission to any and all the foregoing to use any photographs, videotapes, motion pictures, recordings or any other record of this Event for any legitimate purpose. (ผู้เข้าร่วมกิจกรรมยินดีให้สิทธิ์คณะผู้จัดกิจกรรม รวมถึงผู้สนับสนุนกิจกรรมในการบันทึกภาพนิ่ง ภาพโทรทัศน์ ภาพเคลื่อนไหว หรือการบันทึกทุกรูปแบบจากการเข้าร่วมกิจกรรมของผู้เข้าร่วมกิจกรรม และยินดีที่จะให้นำภาพประเภทใดก็ตามไปใช้สำหรับทุกวัตถุประสงค์ที่ชอบด้วยกฎหมาย โดยจะไม่เรียกร้องค่าตอบแทนแต่อย่างใด)
- Participant understands that he/she is responsible for all personal items including but not limited to, cameras, cell phones, clothing, bicycles, etc. (ผู้เข้าร่วมกิจกรรมเข้าใจถึงความรับผิดชอบต่อทรัพย์สินของตนเอง ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะ กล้องถ่ายภาพ โทรศัพท์มือถือ เสื้อผ้า จักรยาน ฯลฯ)
- Participant agrees and understands that the Event can be hazardous and involves the risk of physical injury or death to the Participant. (ผู้เข้าร่วมกิจกรรมยอมรับและเข้าใจถึงความเสี่ยงอันตรายในการเข้าร่วมกิจกรรมที่มีผลต่อผู้เข้าร่วมกิจกรรม ซึ่งเกี่ยวข้องกับอาการบาดเจ็บทางร่างกาย หรือการเสียชีวิต)
4.1 There are inherent risks associated with strenuous physical exercise or exertion which is required in order to participate in the Event, which may cause falls, injuries and/or death to the Participant; and such risks include but are not limited to, equipment failure, rocks of various sizes, uneven and/or slippery conditions, varying weather and surface conditions, varying slopes, loose gravel and dirt, wet surfaces, holes and potholes, debris, other bikes, vehicles, and paved surfaces, the condition of the Participant, dehydration, and changing elevations. (ผู้เข้าร่วมกิจกรรมต้องได้รับการฝึกฝนอย่างถูกต้อง มีร่างกายแข็งแรงสมบูรณ์พร้อมที่จะเข้าร่วมกิจกรรม ทั้งนี้ อาจเกิดการล้ม การบาดเจ็บ และ/หรือการเสียชีวิต ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะ ข้อบกพร่องของยานพาหนะ อุปกรณ์ หินขนาดต่าง ๆ สภาพถนนขรุขระ และ/หรือลื่น สภาพอากาศแปรปรวน สภาพผิวหน้าถนน พื้นลาดชันไม่เท่ากัน กรวด ดิน โคลน ทราย รูต่าง ๆ หลุมบนพื้นถนน การสัมผัสกับยานพาหนะ ผู้เข้าร่วมกิจกรรมคนอื่น ภาวะขาดน้ำ และระดับความสูงที่ไม่แน่นนอน)
